GARRA BRAZILIAN JIU-JITSU ACADEMY

MEMBERSHIP TERMS & CONDITIONS AGREEMENT

1. MEMBERSHIP STRUCTURE & FEES

1.1 Registration Fee

All new members are required to pay a one-time registration fee of $50.00 at the time of joining.
This fee covers account setup and initial administration costs and is strictly non-refundable.

1.2 Membership Term

While membership fees are deducted on a fortnightly basis, your membership is viewed as an ongoing annual commitment to your training and will automatically renew unless cancelled.

• There are no lock-in contracts; you retain control of your membership duration subject to the cancellation policies below.
• Memberships are non-transferable and cannot be shared between individuals.

1.3 Payment Processing (via Stripe)

  • All payments are processed securely through our partner, Stripe.

  • Encrypted Data: All payment information is tokenized and encrypted by Stripe, ensuring that no sensitive card details are stored directly on the Gymdesk platform.

  • Billing Cycle: Fees are charged fortnightly using your nominated debit or credit card.

  • Payment Responsibility: It is your responsibility to ensure your payment method remains valid and has sufficient funds.

  • If your card is lost, stolen, or replaced, you must update your payment details within 48 hours via the Gymdesk member portal to avoid failed payment fees or suspension.

  • Failed Payments & Retries: If a payment fails (insufficient funds, expired card, etc.), a $8.50 Failed Payment Fee will be automatically applied.

  • Stripe will automatically retry failed payments according to its automated schedule (typically every 48–72 hours).

  • Overdue Accounts: If your account remains overdue for more than 7 days, Garra BJJ reserves the right to suspend class access until the balance is cleared. Any training attempted during a period of non-payment may result in back-billing.

1.4 Pricing Adjustments

Garra BJJ reserves the right to adjust membership pricing. Members will be provided with reasonable notice (minimum 30 days) prior to any price changes taking effect.

1.5 Public Holidays & Annual Closures

Membership fees are calculated based on a 52-week year.
Payments continue as scheduled throughout the year, including during public holidays and seasonal breaks.

1.6 Visiting Members (Other Locations)

Garra BJJ members from other affiliated locations/branches are welcome to train at the Kelvin Grove academy.
A discounted casual fee will apply for these visits.

1.7 Refund Policy

All membership fees, registration fees, casual passes, and merchandise purchases are non-refundable, except where required by Australian Consumer Law.

1.8 Family Accounts

Family accounts must use a single payment method.
Each member listed under the family account is subject to the same cancellation, hold, and conduct rules outlined in this agreement.

2. CANCELLATION, HOLD & COOLING-OFF POLICIES

We value flexibility. You may pause or cancel your membership at any time by following the procedures below.
Verbal requests or messages via social media are not accepted.

2.1 Membership Hold (Freeze)

You may pause your training for a minimum of 28 days per calendar year.

• How to Request: Submit a request via the Gymdesk Contact Form or email training@garrabjj.com.au.
• Notice Period: Requests must be received at least 48 hours before the start date.
• Fee: A $20.00 administrative fee applies to each approved hold to keep your account active and spot reserved.
• If a hold is approved after a payment has already been processed, the current paid fortnight remains active, and the hold will apply to the following billing cycle.

2.2 Membership Cancellation

You may cancel your membership via the Gymdesk portal (Membership → Manage → Cancel Membership).

• Cancellation Fee: A $100.00 termination fee applies to all cancellations. This fee is processed automatically upon submission.
• Effect: Access continues until the end of the current billing cycle.

2.3 Private Lesson Cancellation Policy

Private lessons must be booked in advance.
Cancellations or rescheduling requests must be made at least 24 hours prior to the scheduled session.
Failure to provide sufficient notice will result in the forfeiture of the full lesson fee.

2.4 Cooling-Off Period

New members are entitled to a 48-hour cooling-off period commencing from the date of signing this agreement.
If you wish to terminate the agreement within this period, you must notify us in writing.
A refund of the registration fee (minus the cost of any services or merchandise already used) will be provided.

3. ACADEMY RULES & ETIQUETTE

3.1 Code of Conduct

To maintain a safe and respectful environment, the following are strictly prohibited:

• Swearing, spitting, fighting, or aggressive behavior.
• Training under the influence of drugs or alcohol.
• Disrespectful behavior toward instructors, staff, or fellow members.
• Mistreatment or intentional damage of academy equipment.
• Consequences: Garra BJJ reserves the right to terminate or refuse membership immediately if a member engages in dangerous, disruptive, or inappropriate behavior, or repeatedly breaches this Code of Conduct.

3.2 Dress Code & Uniforms

• Mandatory Gear: Members must wear official Garra BJJ uniforms (Gi and No-Gi).
• Compliance: Mandatory gear must be obtained within 10 days of joining.
• Hygiene: Uniforms must be clean, odor-free, and free of tears.
• Grading Attire:
– Adults: White or Blue Official Gi only.
– Kids: White, Blue, or Black Official Gi only.

3.3 Hygiene & Safety Standards

• Infection Control: Members must immediately report any contagious conditions.
Training while knowingly contagious is strictly prohibited and may result in suspension or termination.
• Fingernails and toenails must be kept trimmed short.
• Jewelry must be removed before training.
• Members are responsible for bringing their own water and protective gear (Mouthguard, Cup/Groin guard, etc.).

3.4 Punctuality

Members should arrive on time.
If arriving late, members may join the mat but must wait at the edge of the mat outside until invited in by the Professor to ensure safety and avoid disruption to the class.

3.5 Children & Guests

• Guests: Must sign a waiver before stepping on the mats.
• Children: Must be supervised by a parent/guardian when not in class.
Parents accept full liability for their children while on the premises outside of class participation.
• Parental Responsibility: Parents/guardians acknowledge that instructors cannot provide childcare outside of class hours.
• Behavioral Issues: If a child is persistently disruptive or uncontrollable, Garra BJJ reserves the right to suspend participation.

3.6 Instructor Role (Psychology Disclaimer)

Our instructors are martial arts coaches, not trained psychologists or behavioral specialists.
The safety and well-being of the entire class remains the priority.

4. GRADING & PROGRESSION

Grading is earned through consistency, technical improvement, and character.

4.1 Attendance & Ceremony

Students invited to grade are strongly encouraged to attend the official Grading Ceremony.
However, if an invited student is unable to attend the ceremony, the grading may be awarded during a regular class after the official grading event has taken place.

4.2 Minimum Attendance Requirements

• Adults & Teens (14+): 30 classes since last grading.
• Kids (5–13): 15 classes since last grading.

Note: Meeting attendance requirements does not guarantee a grading.
Progression is at the sole discretion of the Head Instructor.

4.3 Grading Fee

A $60.00 grading fee applies once a student is officially invited to grade.
The grading fee must be paid before the informed due date.
A secure payment form will be emailed to selected students who meet the eligibility criteria.

5. LIABILITY, HEALTH & WAIVER

5.1 Risk Acknowledgement

I understand that Brazilian Jiu-Jitsu involves strenuous physical activity and contact.

• Sparring: I acknowledge that sparring (“rolling”) is a full-contact activity and may involve accidental impacts, submissions, and takedowns.
Participation is voluntary, and I am responsible for communicating discomfort or tapping immediately to stop activity.
• I voluntarily assume all risks associated with participation, including but not limited to sprains, strains, and accidental injury.

5.2 Health Declaration

• I confirm I have answered the Health Questionnaire truthfully.
• Injury Reporting: Members must immediately notify staff of any new injuries (sprains, dislocations, fractures) and must not train until medically cleared.
• Training with Injury: If you choose to train despite a prior injury, you acknowledge that you do so at your own risk.
• Pregnancy: Members who become pregnant must notify management immediately and provide a medical clearance letter to continue training.

5.3 Indemnity

To the extent permitted by law (including the Competition and Consumer Act 2010),
I release and indemnify Garra Group Pty Ltd, its directors, and staff from any claims, demands, or damages arising from my participation.

5.4 Independent Contractors

Garra Brazilian Jiu-Jitsu Academy may engage independent contractors for certain services.
Any claim arising from an act or omission by such contractors will be the responsibility of those contractors, not Garra Group Pty Ltd.

5.5 Medical Treatment

In the event of an injury, I authorize staff to administer first aid or seek emergency medical treatment if required.
I accept responsibility for any resulting medical costs.

6. GENERAL PROVISIONS

6.1 Media Consent

I grant Garra Group Pty Ltd the right to photograph or film me (or my child) during academy activities for use in marketing, social media, and educational materials.
I waive the right to inspect or approve these materials or receive compensation.

6.2 Privacy

Your personal data is stored securely in Gymdesk and Stripe in accordance with the Privacy Act 1988 (Cth).
We do not share your data with third parties except for essential payment processing or legal requirements.

6.3 Lost Property

Garra BJJ is not responsible for lost or stolen items.
Unclaimed property is held for 30 days before being donated to charity.

6.4 Intellectual Property

The “Garra Brazilian Jiu-Jitsu” name, logo, and associated artwork are the exclusive property of Garra Group Pty Ltd.
Members are strictly prohibited from using the academy’s branding on unauthorized merchandise, clothing, or for personal business promotion without express written permission.

6.5 CCTV & Safety Recording Consent

For safety, security, and operational purposes, Garra BJJ operates CCTV cameras in common areas.
By entering the premises, members consent to video recording for:

• Safety monitoring
• Incident review
• Theft prevention
• Quality and facility control

Recordings are stored securely and not publicly released unless required by law.

6.6 Instructor Certification & Representation

Members are encouraged to pursue their development as instructors.
However, to officially represent the Garra Academy, teach the “Garra System,” or use the Academy’s branding, the Member must first obtain written certification from the Head Coach.

Certification requires:
• Successful completion of the Garra Teacher Training Course.
• Passing a practical technical assessment.
• Submission of a valid National Police Check and Blue Card.
• Demonstrated alignment with the Academy’s core values and culture.

6.7 Amendments

Garra BJJ reserves the right to modify these terms with 30 days’ notice.
Continued use of the facilities after this period constitutes acceptance of the new terms.

6.8 Governing Law & Severability

This Agreement is governed by the laws of Queensland, Australia.
If any part of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

7. MEMBER ACKNOWLEDGEMENT

By digitally signing or submitting this agreement, I acknowledge and confirm that:

I have read, understood, and agree to the Garra Brazilian Jiu-Jitsu Academy Membership Terms & Conditions in full.
This includes my acceptance of the cancellation/hold fees ($100 cancellation / $20 hold), refund policy, assumption of risk, code of conduct, CCTV consent, and grading fee structure ($60 upon invitation).
I understand that my digital submission constitutes a legally binding agreement.
